1.4借款利率
本合同适用之利率浮动幅度、执行利率、利率调整方式等信息见本合同第二十六条。
1.4.1本合同适用浮动利率,即以借款发放日中国人民银行同期同档次人民币贷款基准利率为基础浮动上浮或下浮一定比例(具体见本合同26.0确定执行年利率。借款发放后,遇中国人民银行人民币贷款基准利率调整,借款执行利率按借款人自下述方式中所选择的方式进行调整,具体见本合同26.2。各方按调整后相应期限档次的基准利率和本合同约定的借款利率浮动幅度确定新的借款执行利率。
(1)自中国人民银行人民币贷款基准利率调整生效当日起调整。
(2)以本合同26.2约定的月数(从借款发放之日起至次月的借款发放日的对应日为一个月,以此类推;如无借款发放日的对应日,则为次月较后一天)为一个调整周期。在一个调整周期内,如遇中国人民银行人民币贷款基准利率调整,则借款执行利率自下一个周期首月的借款发放日的对应日起进行调整,如无借款发放日的对应日,则自该月较后一天起调整。
(3)自中国人民银行人民币贷款基准利率调整后的次年1月1日起调整。
1.4.2本合同执行利率以人民银行基准利率为基础下浮的,在借款期限内,如借款人在中国农业银行申请的借款(包括但不限于本合同项下的借款)出现连90天(含)以上或累计180天(含)以上逾期记录,贷款人有权取消利率下浮,并自逾期之日起至本合同项下借款到期之日止,将本合同项款执行利率调整为人民银行同期同档次人民币贷款基准利率。

Part I General Terms
Borrowing
Article 1 Borrowing
1.1 The amount of loan is set forth in article 23 hereof.
1.2 Purpose of borrowing.
1.2.1 The purpose of the loan hereunder is set forth in clause 24.1.
1.2.2 For details of the borrower's purchase of real estate, please refer to this contract, clause 24.2.
1.3 The term of the loan is set forth in Article 25 of the contract.
1.4 Loan interest rate
See article 26 of the contract for such information as fluctuation range, implementation rate and adjustment mode of interest rate applicable to this contract.
1.4.1 The applicable floating interest rate shall be determined on the basis of the loan issuance date of the People's Bank of China in the same period as the benchmark interest rate of RMB loan interest rate for the same period (specifically clause 26.1 of the contract). In case of adjustment of the benchmark interest rate of RMB loans of the People's Bank of China after the loan is issued with a determined annual interest rate, the loan execution rate shall be adjusted according to the manner chosen by the borrower as specified in clause 26.2 of this contract. The parties shall determine the new loan execution rate according to the adjusted benchmark interest rate of the corresponding term and the fluctuation range of the loan interest rate agreed herein.
(1) The adjustment shall take effect on the effective date of the adjusted benchmark interest rate of RMB loans of the People's Bank of China.
(2) The number of months as agreed in clause 26.2 hereof ( from the date of loan issuance to the corresponding date of the next month shall be one month, and so on; If there is no corresponding date, it is the last day of the next month), which is an adjustment cycle. In one adjustment cycle, in case of adjustment of the benchmark interest rate of RMB loans of the People's Bank of China, the execution rate of the loan shall be adjusted from the corresponding date of the loan issuing date in the first month of the next cycle. If there is no corresponding date of the loan issuing date, it shall be adjusted from the last day of the month.
(3) It shall be adjusted as of January 1 of the following year after the People's Bank of China adjusts the benchmark interest rate of RMB loans.
1.4.2 The implementation rate of this contract shall be floating down on the basis of the benchmark interest rate of the People's Bank of China. And within the term of the loan, if the Borrower is reported overdue records in loans from Agricultural Bank of China (including but not limited to loans hereunder) for more than 90 consecutive days (including) or 180 days (including) accumulated, the lender shall have the right to cancel the interest rate deduction and adjust the interest rate of the loan under this contract to be same as the benchmark interest rate of the People's Bank China for the same period from the date of overdue repayment to the ending date of the loan under this contract.
